2. Petitioner seeks regular bail in a case registered for the offence punishable under sections 30(a), 41 and 47 of the Bihar Prohibition and Excise Amendment Act.

3. As per the prosecution case, total 406.970 liters of foreign liquor was recovered from the seized Tata Magic bearing registration no. BR01CQ3222.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. No incriminating material has been recovered from conscious possession of the petitioner and he has got no concern with the aforesaid recovery. Petitioner is not the registered owner of the seized Tata Magic. Petitioner is only the driver of

5. Learned A.P.P. for the State vehemently opposes the regular bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the regular bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exlusive Special Court Excise-2, Nawada in connection with Nawada Excise PS Case No. 472 of 2026.
