Despite valid service of notice, opposite party no.2 has chosen not to appear before the Court.
The petitioner seeks anticipatory bail in connection with Complaint Case No.3296 of 2012 in which cognizance has been taken for the offences punishable under section 498-A of the Indian Penal Code and section 4 of the Dowry Prohibition Act. It is contended that there is no truth behind the allegations made in the FIR and the complainant has instituted the case due to matrimonial discord and incompatibility. He has
Patna High Court Cr.Misc. No.42226 of 2014 (4) dt.23-07-2015 2/2 submitted that despite efforts made by the petitioner, the complainant has refused to live in the matrimonial home. On the other hand, learned counsel for the State has opposed the prayer for bail. He has submitted that there is allegation that the petitioner and others subjected the complainant to cruelty for non-fulfillment of demand of dowry. Be that as it may, regard being had to the facts and circumstances of the case, the provisional anticipatory bail granted to the petitioner by this Court vide order dated 20th March, 2015, is hereby confirmed.
