JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bisfi (Patauna) P.S. Case No. 144 of 2014 registered for the offences punishable under Sections 419, 420, 467, 468, 471, 409 of the Indian Penal Code.

At the very outset, learned counsel for the petitioner submits that petitioner has already handed over charge and deposited the amount in question. He drew my attention towards Annexure-2 series which show that by three separate receipts petitioner deposited near about Rs. 44,000/-. So far as charge report is concerned, learned counsel for the petitioner submits that presently the charge report is not in possession of the petitioner. Considering the aforesaid facts and circumstances as

No.6652 of 2015 (2) dt.19-02-2015 well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Subir Kumar, Judicial Magistrate 1st Class, Madhubani in Bisfi (Patauna) P.S. Case No. 144 of 2014 subject to condition as laid down under Section 438(2) of the Cr.P.C and furthermore, at the time of furnishing bail bonds the petitioner shall produce charge report before the court below and if he fails to do so, the bail bonds of the petitioner shall not be accepted by the court below.
