JUSTICE ARUN KUMAR ORAL ORDER 09-08-2018 Heard learned counsels for the petitioner, learned counsel for the opposite party no.2 as well as the State. The petitioner, already in custody, seek bail in connection with T.R. No. 1534 of 2018, arising out of Gaya, Complainant Case No. 197 of 2017, registered under Sections 323, 368, 379 read with 34 of the I.P.C.

Learned counsel for the petitioner submits that this case was instituted after seven years of the alleged occurrence. The complainant was admitted in the private clinic of Dr. Jagdeo Singh in the year 2010 and a dead child was borne. Now the allegation is made against the petitioner or compounder of the clinic that he exchanged the new born baby with a newly

Having considered the aforesaid facts and circumstances, the petitioner, namely Luv Kush Kumar @ Luv Kush Compounder @ Lav Kush Kumar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Gaya, in connection with T.R. No. 1534 of 2018, arising out of Gaya, Complainant Case No. 197 of 2017.
