The petitioners apprehend their arrest in connection with Bettiah Town (Kalibag O.P.) P.S. Case No.29 of 2021, registered for the offences punishable under Sections 341, 323, 420, 504 and 506 of the Indian Penal Code as well as Section 138 of the N.I. Act.
The petitioners are said to have purchased ready made clothes worth Rs.18,51,110/- on credit from the informant, but
Patna High Court CR. MISC. No.50352 of 2022(3) dt.17-04-2023 2/3 did not pay money.
Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. The petitioners no.1 and 2 have got one criminal antecedent whereas petitioner no.3 has got no criminal antecedent as stated in paragraph-3 of the bail petition. It is further submitted that the matter was referred to Patna High Court Mediation and Conciliation Centre, but the matter has not been settled. The dispute between the parties is purely civil in nature.
Learned APP for the State as well as learned counsel for the informant opposed the prayer for grant of anticipatory bail to the petitioners by submitting that the petitioners issued three cheques to the informant but when the informant presented the cheque before the bank for payment, the cheque got dishonoured due to insufficient balance.
Taking into consideration the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned
