ANJANA MISHRA ORAL ORDER 27-04-2016 By the present modification application, the petitioner seeks modification of the order dated 21.08.2015 passed in Cr. Misc. No. 35375 of 2015 for extending the time for depositing the 20% of the alleged defalcated amount.
It is submitted that the petitioner was required to deposit around Rs. 1328012.6/- but has been able to deposit only rupees five lacs till date. However, he is willing and ready to deposit the rest amount within a period of four months.
Considering all facts and circumstances, this Court, while taking a lenient view, is granting a further extension of four months for depositing the rest amount, from the date of receipt/production of a copy of this order. The petitioner shall positively deposit the rest amount which remains of the 20% so
Patna High Court Cr.Misc. No.17842 of 2016 (2) dt.27-04-2016 2/2 directed to be deposited within the aforesaid period. In case, the petitioner does not deposit the same for any reason, the order dated 21.08.2015 shall stand automatically recalled.
The order dated 21.08.2015 stands modified to the said extent.
