Petitioner is in custody since 05.05.2018 in connection with Special Case No. 53 of 2018 arising out of Sadar P.S. Case No. 193 of 2018 registered under Sections 341, 342, 372, 373, 376, 366(A) and 120(B) of the Indian Penal Code and 3, 4, 5, 6 of Immoral Traffic Act, 1956 and 23 of Juvenile Justice Act and Section 3and 4 of the POCSO Act, 2012.
Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. Neither the petitioner was involved in the business of immoral trafficking nor he was arrested in any objectionable condition rather he has been made accused in this case on the basis of suspicion only. No any witnesses during course of investigation has supported in the implication of this petitioner in the
Patna High Court Cr.Misc. No.42226 of 2018 (2) dt.19-07-2018 alleged occurrence. The petitioner is rotting in judicial custody for the last two months.
Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned Special Judge, POCSO Act, Purnea in connection with Special Case No. 53 of 2018 arising out of Sadar P.S.
