JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bihta P.S. Case No. 385 of 2013 registered for the offences punishable under Sections 341, 323, 325, 307, 379/34 of the Indian Penal Code.

Considering the allegation levelled against the petitioner as well as submissions advanced on his behalf, I am not inclined to grant the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Bihta P.S. Case No. 385 of 2013 pending in the court of Additional Chief Judicial Magistrate, Danapur, Patna stands rejected.

However, if petitioner surrenders before the

No.11622 of 2015 (2) dt.26-03-2015 concerned court within four weeks from today and seeks regular bail, the prayer for regular bail of the petitioner shall be considered on its own merit without being prejudiced by this rejection order, particularly, keeping in mind that the informant has sustained simple injury, said to be caused by hard and blunt substance.
