Mr.A.G ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-10-2021 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in Jakkanpur Police Station Case No. 316 of 2020 registered for the offences punishable under section 399 and other allied sections of the Indian Penal Code and sections 25(1-B)(a), 26 and 35 of the Arms Act.

As per the prosecution case, police arrested the petitioner and other accused persons and recovered cash of Rs.22 lacs and odd from the house of the petitioner, said to be looted from the Punjab National Bank few days back. A country made pistol and eight live cartridges were also recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this

Patna High Court CR. MISC. No.8103 of 2021(8) dt.26-10-2021 2/2 case on suspicion. Petitioner's name has figured during course of investigation in his self confessional statement. Petitioner has got clean antecedent as stated in paragraph 3 of the bail petition. Petitioner is in custody since 3.7.2020.

Learned counsel for the State opposes the prayer for bail and submits that there is recovery of huge cash from the petitioner's house which is said to be looted in bank robbery. Considering the recovery of huge amount of cash from the house of the petitioner which was looted from the bank, his prayer for bail is refused.
