20.05.2015 The Petitioner who is the Informant seeks cancellation of bail of the Opposite Parties No. 2 to 5 on the ground that the similar prayer of the Opposite Party No. 2 was dismissed as withdrawn vide Cr. Misc. No. 25266 of 2010 on 09.02.2012 but suppressing this fact that the order for quashing the proceeding was obtained by this Court on 30.09.2013.
In view of such, the order dated 30.09.2013 passed in Cr. Misc. No. 12554 of 2010 by which the order of cognizance dated 27.11.2009 passed by the Chief
Patna High Court Cr.Misc. No.14433 of 2014 (8) dt.20-05-2015 Judicial Magistrate, Patna in Digha P.S. Case No. 90 of 2009 was quashed is, herby, recalled.
The Court below shall continue with the prosecution in accordance with law and conclude the same within a period of six months from the date of receipt of this order without granting unnecessary adjournment to any party.
The Modification Application stands allowed with the aforesaid observations.
