The petitioner, already in custody, seeks bail in connection with Gopalpur P.S.Case No. 138 of 2017 registered under Sections 307/34 of the Indian penal Code and 27 of the Arms Act.

Allegation in brief is that petitioner shot on the chest of the informant in his home.

Submission is that there is case and counter case, subsequent case is lodged by the petitioner's side in which Shekhar Rai was caused firearm injury in his left leg by the present informant.

Learned counsel for the State submits that earlier case was lodged by the informant's side in the present case and specific accusation against the petitioner is of giving firearm injury in the chest of the informant which is vital part of the

Patna High Court Cr.Misc. No.41752 of 2018(2) dt.12-07-2018 2/2 body.

Having considered the specific accusation against the petitioner, prayer of bail is rejected, however, he may renew prayer of bail after one year if trial does not get concluded. (Arun Kumar, J) sujit/- U T
