The petitioner apprehends his arrest in Falka P.S. Case No. 151 of 2021, registered for the offences punishable under Sections 379, 354 and other allied sections of the Indian Penal Code.
Prosecution case in brief is that on the alleged date and time of occurrence, all the accused persons including this petitioner assaulted the informant with fist and slaps and knocked him down due to which his upper teeth broken. Wife of informant was also assaulted by the accused persons and coaccused Bandna Kumari snatched chain from her neck. It is submitted that allegation of assault is general and omnibus and no specific overt act has been alleged against this
Patna High Court CR. MISC. No.61103 of 2021(2) dt.05-07-2022 2/2 petitioner. Case and counter case. Due to land dispute between the parties an altercation took place in which both sides sustained injury. Petitioner claims clean antecedents. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IIIrd, Katihar in connection with Falka P.S. Case No. 151 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
