Petitioners apprehend their arrest in connection with Kartahan P. S. case no. 80/2014 registered under section 307 and other allied sections of the IPC.

Petitioners are named in the first information report but according to the prosecution case itself, it were co-accused Krishna Rai and Sudama Rai who assaulted informant by Hasua and similarly, husband of the informant was assaulted by co-accused Satyendra Prasad Yadav.

The contention on behalf of the petitioners is that petitioners have been implicated in this case on account of land dispute and moreover, injured have sustained simple injury. Considering the aforesaid facts and circumstances as well as

No.6676 of 2015 (2) dt.19-02-2015 submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in Kartahan P. S. case no. 80/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
