2. The present petition has been preferred for the following relief/s:
(i) for issuance of an appropriate writ(s), order(s), direction(s) to the respondents for demarcating the land being Khata No. 480, Plot No. 486, 487 total area 2 acre 39 decimal 400 worg kari which is situated MauzaBalua, Panchayat-Balua Kaliyaganj, Block Palasi under District-
Patna High Court CWJC No.10707 of 2026(2) dt.24-07-2026 2/3 Araria the same land have been purchased by petitioners on 30.01.2024 from the Iswari Devi and others through registry thereafter who have came in possession and who have applied for the mutation before concern authorities and after due verification jamabandi and mutation has made in favour of petitioners and who have paid the revenue to the Government and got rent receipt till 2025 but in the meantime adjoining raiyat respondent no. 4 has made hindrance and some part of the land has been made captured by them due to that reason apprehension has made breach of place, so demarcation is necessary for the above mention land petitioners have filed the several representation before concern authority which is pending till today and after demarcation further give the direction to give the possession of the petitioners on that very land.
3. Learned State counsel at the very outset has
Patna High Court CWJC No.10707 of 2026(2) dt.24-07-2026 3/3 pointed out to the Annexure-P/3 to show that through speed post, the prayer for measurement has been made instead, a proper petition should have been filed alongwith the requisite fee.

This Court has taken note of the postal received which is dated 24.06.2026 and is in line with the submission put forward by the learned State counsel, the petitioner is directed to prefer a fresh petition alongwith the requisite fee in next four weeks and in case, the same is filed, the Circle Officer, Plasi, Araria shall be taking the matter to its logical conclusion at the earliest after noticing/hearing/taking measurement in the presence of all the parties.
5. With the aforesaid observation, the writ petition is disposed of.
