JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Dighwara Police Station Case No. 149 of 2014 registered for the offences punishable under Sections 147, 148, 323, 341, 354, 379, 452 and 307/34 of the Indian Penal Code.

It would appear from perusal of the first information report that alleged occurrence took place on account of land dispute and the accusation against the petitioner is that he gave sword blow on the head of the injured Bharat Sah. The injury report of Bharat Sah has been annexed as Annexure-2 to this petition, the injury report of Bharat Sah reveals that he sustained two injuries on his head but both the aforesaid injuries are simple

Patna High Court Cr.Misc. No.9698 of 2015 (2) dt.10-03-2015 2/2 in nature caused by hard and blunt substance. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in Dighwara Police Station Case No. 149 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
