JUSTICE PRABHAT KUMAR JHA ORAL ORDER 18-07-2016 Heard the learned counsel for the petitioner, the learned Additional Public Prosecutor for the State and the learned counsel for the informant.
The petitioner apprehends his arrest in Arwal P.S. case 24 of 2016 under Section 420, 467, 468, 471, 323 and 504 of the Indian Penal Code.
It is alleged that the petitioner fraudulently withdrew money from the account of informant.
It is submitted that petitioner had taken loan of Rs. 15 lacs from the informant and he returned the entire amount. The learned counsel for the informant, however, vehemently opposed the prayer for anticipatory bail. It appears that the dispute arose on account of
Patna High Court Cr.Misc. No.18324 of 2016 (3) dt.18-07-2016 2/2 lending of money as the petitioner is claiming that he has returned the entire amount whereas the informant is claiming that Rs. 14 lacs more is due against the petitioner.
Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal in Arwal P.S. Case No. 24 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
