JUSTICE ARVIND SRIVASTAVA ORAL ORDER 03-01-2022 At the outset, learned counsel for the petitioner seeks permission to withdraw the application as against petitioner no. 1 as he has been arrested during pendency of this application. Permission is granted.
The application, thus, stands dismissed as withdraw as against petitioner no. 1.
Heard learned counsels for the petitioner and the State.
Petitioner apprehends arrest in connection with Khagaria (Mufassil) P.S Cae No. 23 of 2020 registered for the offence punishable under sections 341, 323, 307,
Patna High Court CR. MISC. No.14764 of 2021(3) dt.03-01-2022 2/2 504/34 of the Indian Penal Code and section 27 of the Arms Act.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing specific alleged against this petitioner. The specific allegation is against Saroj Choudhary @Madhu Choudhary. Moreover, there is case and counter case between the parties.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner no. 2, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Khagaria (Mufassil) P.S. Case No. 23 of 2020 subject to the conditions laid down under section 438(2) Cr.P.C.
