====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 10-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 5.5.2018, seeks bail in Pakridayal PS Case No. 62 of 2018 registered under Section 379 of the IPC.

Learned Counsel for the petitioner submits that the petitioner's name has been disclosed by the villagers but his specific name is not mentioned in the FIR, he was apprehended by the police two days after the occurrence and the stolen motorcycle has not been recovered from his possession rather only 1600 rupees cash is said to have been recovered and there is no antecedent of theft against the petitioner.

Having considered the said facts and circumstances, the petitioner, namely, Md. Rabrej Alam is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Motihari in connection with Pakridayal PS Case No. 62 of 2018.
