The petitioner is in custody since 29.05.2018 in connection with Khagaria (Muffasil) P.S. Case No. 32 of 2016 for the offence registered under Sections 302 and 201/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that the first information report is registered against unknown person by the Chowkidar of the village, but subsequently, on the basis of the confessional statement made before the police by co-accused Deepak Yadav, the petitioner was arrested, which has no evidentiary value.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.42542 of 2018 (2) dt.19-07-2018 the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Khagaria (Muffasil) P.S. Case No. 32 of 2016.
