===================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL ORDER 21.05.2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends arrest in Risiup P.S. Case No. 49 of 2012 dated 18.12.2012 instituted under Sections 419/420/467/468/34 of the Indian Penal Code. The allegation against the petitioner is that he along with two other persons had managed to switch A.T.M. card of the informant for ulterior motive.

Learned counsel for the petitioner submits that he was not caught at the spot and only because of the name taken by two other persons who were caught, he has been implicated. It is further submitted that petitioner having clean antecedent.

Learned A.P.P.

opposes the prayer for anticipatory bail and submits that two persons have been caught when there were three persons who had done the job of

At this stage, learned counsel for the petitioner seeks permission to withdraw the application so as to surrender before the Court below and seek regular bail. Accordingly, the application stands disposed off as withdrawn.

In the event the petitioner surrenders and prays for regular bail before the Court below, the same shall be considered on its own merits in accordance with law without being prejudiced by the present order.
