JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 354 of the Indian Penal Code.

It is alleged that the minor daughter of the informant went to purchase some articles from the shop of the petitioner then the petitioner outraged the modesty of the daughter of the informant. The statement of the victim was recorded on the direction of learned court below on 31.12.2014 where the victim has supported the accusation.

It is submitted by learned counsel for the petitioner that for the occurrence of 16.06.2014, the FIR was registered on 20.06.2014. It is further submitted that since the informant failed to clear the dues as the petitioner supplied the articles from his

Patna High Court Cr.Misc. No.14169 of 2015 (2) dt.07-04-2015 2/2 shop on credit, hence the present case has frivolously been lodged. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts particularly the delayed lodging of the case constitute good ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Dhanarua P.S. Case No. 183 of 2014 pending in the court of learned SDJM, Masaurdhi, Patna. Accordingly, the application is disposed of.
