JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2018 Heard the learned counsel for the petitioner and State. The petitioner is in custody in connection with Harnaut (Kalyan Bigha) P.S. Case No. 175 of 2018 for the offence under Sections 272, 273, 290 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and she is in custody in contention with seizure of 51.25 liters liquor. Learned counsel submits that nothing was recovered from the conscious possession of the petitioner. Petitioner is in custody since 09.06.2018.

Considering the fact that the petitioner has no criminal antecedent and she is lady, let the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.

Patna High Court Cr.Misc. No.40318 of 2018(2) dt.10-07-2018 2/2 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judge-cum-Special Judge, Excise, Nalanda at Biharsharif, in connection with Harnaut (Kalyan Bigha P.S. Case No. 175 of 2018.
