====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 11-07-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Hathuwa P.S.Case No. 15 of 2018 registered under Sections 147, 148, 149, 307, 323, 324, 325, 379 and 504/34 of the Indian penal Code.
Learned counsel for the petitioner submits that there is land dispute between both sides and petitioner is only alleged to be a member of unlawful assembly but no specific overt act against him of assaulting anyone rather accusation is specific against other co-accused persons and petitioner has no criminal antecedent.
Learned counsel for the informant opposes the prayer of bail.
Having considered the aforesaid facts and circumstances,
Patna High Court Cr.Misc. No.41378 of 2018(2) dt.11-07-2018 2/2 the petitioner, namely, Ash Naryan Singh @ Ash Narayan, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Gopalganj in connection with Hathuwa P.S. Case No. 15 of 2018.
