JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-09-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Dumariya P.S. Case No. 09 of 2019, registered for the offences punishable under Sections 147, 148, 149, 449, 302 and 120(B) of the Indian Penal Code, section 27 of the Arms Act and section 16/18 of the U.A.P Act.

It is alleged that 30 to 35 Naxalites committed murder of husband of informant and the petitioner is said to have involved in the alleged crime.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case due to village politics. Petitioner is in custody since 16.05.2019 having no criminal antecedent. Other co-accused of this case have already been granted bail by Coordinate Benches of this court vide

Patna High Court CR. MISC. No.48510 of 2019(3) dt.20-09-2019 2/2 orders dated 09.08.2019 and 02.09.2019 passed in Cr. Misc. Nos. 36104 of 2019 and 55022 of 2019 respectively. Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000 (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Sherghati, Gaya in connection with Dumariya P.S. Case No. 09 of 2019.
