JUSTICE ANIL KUMAR SINHA ORAL ORDER 17-04-2021 Heard Mr. Sanjay Kumar Singh, learned counsel for the petitioner and Mr. Choubey Jawahar, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Kutumba (Aurangabad) P.S. Case No. 133 of 2020 registered for the offences punishable under Section(s) 147, 148, 149, 302 and 506 of the Indian Penal Code, 1860.

The allegation as per the First Information Report is that the petitioner along with other accused persons, seven in numbers, had threatened Jagdish Ram (deceased) on 10.8.2020 of dire consequences and on the date of occurrence i.e. on 13.8.2020 all the accused persons caught hold the deceased Jagdish Ram and assaulted him. Patna High Court CR. MISC. No.7971 of 2021(2) dt.17-04-2021 2/3 Ram, Vinit Ram, Sudama Ram and Ravindra Ram assaulted the father-in-law of the informant by means of Gadansa and Tangi, due to which, he died.

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and she has falsely been implicated in this case only because she happens to be the wife of co-accused Vinit Ram and there is no specific allegation of assault and slitting the neck of the deceased against the petitioner. Learned counsel further submits that altogether 17 persons have been made accused in this case and there is specific allegation of assault against Uday Ram, Vinit Ram, Sudama Ram and Ravindra Ram. Learned counsel also submits that the petitioner is a lady and one similarly situated co-accused person namely, Lalita Devi, has been granted bail by a co-ordinate Bench of this Court in Cr. Misc. 3858 of 2021. Learned counsel next submits that the petitioner is in custody since 14.8.

2020 having no criminal antecedent and charge sheet has already been submitted in the matter.

Patna High Court CR. MISC. No.7971 of 2021(2) dt.17-04-2021 3/3 by a co-ordinate Bench of this Court as well as charge sheet has already been submitted in the matter, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Kutumba (Aurangabad) P.S. Case No. 133 of 2020.

It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing.
