Petitioners seek bail in a case registered for the offence punishable under section 342, 343, 376, 120(B) of the Indian Penal Code and Section 4 of the POCSO Act. Learned counsel appearing for the petitioners submits
Patna High Court CR. MISC. No.51043 of 2019(3) dt.19-11-2019 2/2 that petitioners have been falsely implicated in this case. From the FIR, it appears that the informant had gone with accused Gudiya Praveen at several places but she has not made any complain anywhere or raised halla. In the medical report, no sign of rape has been found. Petitioners have no criminal antecedent. Petitioners are in custody since 26.10.2018. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.D.J.I -cum- Special Judge (POCSO) Act, Aurangabad in connection with Children Court Case No. 01/2019, arising out of Mahila P.S. Case No. 29/2018.
