The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 354, 307, 379 and 324/34 of the Indian Penal Code.
The accusation is of assaulting the informant by the petitioner with axe on the head when the mother of the informant came to rescue she was being assaulted and wife of the petitioner snatched gold chain of the mother of the informant. It is submitted by learned counsel for the petitioner that in the background of land dispute, accusation has been levelled. The injury report reflects only one lacerated wound injury of marginal size on the head of the informant caused by hard and blunt substance. It is further submitted that for occurrence of 15.11.2014, F.I.R. was registered on
Patna High Court Cr.Misc. No.11145 of 2015 (2) dt.18-03-2015 2 / 2 21.11.2014. There is counter version of occurrence also. A statement has been made in paragraph no. 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Bibhutipur P.S. Case No. 323 of 2014, on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Rosera, Samastipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
