JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-05-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 307, 354, 379, 380, 504, 506 of the Indian Penal Code.
The prosecution case is that the accused persons variously armed entered into courtyard of the informant and started taking household articles and on protest being made petitioner No.1, Umanand Bahardar, assaulted the son of informant, Manoj Bahardar, whereas petitioner No.2, Tuntun Bahardar, assaulted Mathuranand Bahardar with Farsa. Patna High Court Cr.Misc. No.20218 of 2016 (2) dt.09-05-2016 2/2 alleged that accused persons took away golden locket from the neck of informant' son and a box containing gold and silver ornaments, Rs. 35,000/- cash and clothes.
It is submitted by the learned counsel for the petitioners that injury of Manoj Bahardar, son of informant, has been found to be grievous whereas injury of Mathuranand Bahardar has been found to be simple. There is counter version and three persons from petitioners' side have also received grievous injuries. Statement has been in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Forbesganj P.S. Case No. 70 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
