1. The present writ petition has been filed seeking the following relief(s):- "1. That this is an application for issuance of a writ in the nature of mandamus directing and commanding the respondent authorities to remove the encroachment from the land

Patna High Court CWJC No.11488 of 2023(2) dt.17-10-2023 2/2 appertaining to C.S. Khata no. 569, C.S. plot no. 3742 and C.S. Khata no. 608, C.S. plot no. 3733 which is road belonging to Bihar Government in pursuance of order dated 23.12.2022 passed by the learned S.D.M. Nawada u/s 133 Cr.P.C. in case no 723 of 2013/Case No.-572/2019 and/ or for issuance of an appropriate writ(s), order(s) or direction(s), which seems just and equitable in the facts and circumstances stated hereunder."

2. At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law, for redressal of the aforesaid grievances. Liberty so sought is granted.
