As the Electricity Department was resisted in getting a tower erected in his land by the petitioner motivating others also, instant prosecution has been filed. It is further evident that for the aforesaid activities CWJC No.195 of 2014 had already been instituted which has been disposed of by an order dated 05.05.2015 wherefrom it is apparent that tower had already been erected and further, petitioner has been given a liberty to ask for compensation.

Accordingly, petitioner Shambhu Prasad is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Tisiauta P.S. Case No. 100 of 2013 in the event of his arrest / surrender within four weeks from

Patna High Court Cr.Misc. No.38140 of 2014 (3) dt.06-07-2015 production / receipt of the order in terms of condition so laid down under Section 438(2) Cr.P.C.
