JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under section 366A/34 of the Indian Penal Code.
The accusation is of kidnapping the minor daughter of the informant. In 164 Cr.P.C. statement the victim has got her age recorded as 14 years where she stated that she was called by this petitioner and subsequently this petitioner called her son Sunil and both forced the victim to sit on motorcycle, ultimately she was confined in the house of Munna Ram.
It is submitted by the learned counsel for the petitioner that the victim was recovered from the house of Munna Ram and the FIR has been registered after six days of the occurrence and
Patna High Court Cr.Misc. No.11260 of 2015 (2) dt.29-04-2015 2/2 164 Cr.P.C. statement appears to be tutored one as the same was recorded after about two days of the return of the victim. It is further submitted that co accused Sunil Ram has been granted bail. This court finds ground for the learned court below to consider prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Vishambharpur P.S. Case No. 89 of 2014 pending in the court of learned J.M. Ist Class, Gopalganj.
This application is disposed of with the aforesaid observation/direction.
