Case No. 1694 of 2002 on the file of Chief Judicial Magistrate, Araria. The offences referable to sections 386 and 420 of the Indian Penal Code were alleged. The petitioner filed A. B. P. No. 954/13 before the Additional District Judge, 1st, Araria. The same was rejected on 17-12-2013. Hence this application.

Heard learned counsel for the petitioner and learned A.P.P. for the State.

It is rather unfortunate that the case registered way back in 2002 is said to be still pending, and that too substantial time was spent by the courts in dealing with the anticipatory bail.. It is brought to the notice of this Court that the co-accused by name Kamleshwari Yadav was granted anticipatory bail by this

Patna High Court Cr.Misc. No.719 of 2014 (5) dt.25-06-2015 2/2 Court. Even if that is true, this Court is of the view that the petitioner must appear before the trial court at least to facilitate the early disposal of the case.

Hence, the petition is disposed of, directing that the petitioner shall appear before the trial court within four weeks from today, and if he moves an application for bail, it shall be taken up on the same day, and the order passed therein. The trial court shall dispose of the main case itself within two months from the date of appearance of the petitioner, and any default in this behalf shall be taken serious note of.
