JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-05-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State and learned counsel for the informant.
Petitioner apprehends his arrest in connection with Complaint Case No. 1479 of 2014 registered for the offences punishable under Sections 498A, 406, 494, 379 of the Indian Penal Code.
According to complaint case itself, the marriage of the complainant was solemnized in the year 2002 with elder brother of the petitioner but the husband of the complainant became traceless after two years of the marriage and thereafter, in the year 2005 the
Patna High Court Cr.Misc. No.10557 of 2015 (3) dt.06-05-2015 2/2 petitioner solemnized his marriage with complainant with the permission of his family members as well as natal people of complainant and after marriage complainant gave birth to three children but subsequently, in the year 2014 petitioner attempted to solemnize his another marriage which was got restrained by the complainant through police and thereafter, she along with her children were ousted from her matrimonial home. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the SubDivisional Judicial Magistrate, Siwan in Complaint Case No. 1479 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
