ANJANA MISHRA ORAL ORDER 27-07-2018 Heard learned counsel for the petitioner and the State. The petitioner is languishing in jail since 05.05.2018 in connection with Gaurichak P.S. Case No. 291 of 2017 registered under Sections 420 and 120B of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that the present petitioner has nothing to do with the purchase and sale of the land, for which there was a dispute between the informant and Ajay Singh. The only reason why the petitioner has been implicated is that this petitioner had sold a piece of land earlier to the informant and since some money was due between the parties, the present case has been instituted with malicious intention. Learned counsel for the petitioner further submits that if at all any dispute exists between the parties of the
Patna High Court Cr.Misc. No.42877 of 2018(2) dt.27-07-2018 2/3 sale deed which has been referred to herein, the persons who had participated in the said transaction would be held up and not the present petitioner. Apart from this case, one other case is pending against the petitioner.
Considering the aforesaid facts and circumstances let the petitioner, named above, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Gaurichak P.S. Case No. 291 of 2017 to the satisfaction of the Additional Chief Judicial Magistrate, Patna City, Patna on the following conditions.
(1) One of the bailors will be their own blood relative, preferably father, mother, brother, sister of petitioner.
(2) The petitioner shall not indulge himself in any similar offence till conclusion of the trial.
(3) The petitioner shall remain physically present in Court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, his bail bond shall be liable to be cancelled by the learned Court concerned.
(4) The petitioner shall co-operate with the investigation, if not already concluded, and make himself
