JUSTICE VIKASH JAIN ORAL JUDGMENT (Per: HONOURABLE THE ACTING CHIEF JUSTICE) Date: 30-11-2016 The petitioner has sought a direction to the respondents for grant of permits to the applicants/bus owners for plying city bus service on the route no.4 (A.G. Colony to Patna Junction). In the counter affidavit filed on behalf of the respondents, it is pointed out that the applications were invited from the bus owners, but a detailed report was called for from S.P. (Traffic) and District Transport Officer, Patna on 05.12.2014. As per the said report, it is pointed out that the construction work of fly over from Patna Junction to G.P.O. is going on and there is always traffic
Patna High Court CWJC No.4536 of 2015 dt.30-11-2016 2/2 congestion. It is also pointed out that grant of permit on route no.4 would be beneficial for the passengers of A.G. Colony, but grant of permits for movement of new vehicles from A.G. Colony to Sheikhpura crossing will not be desirable till the construction of fly over near Sheikhpura crossing is completed. It is also pointed out that tempos are plied in large numbers from Digha to Bailey Road via Ashiyana and A.G. Colony. Hence, there would be no difficulty for the commuters to catch buses and tempos running on Bailey Road from Danapur to Patna Junction.
In terms of the counter affidavit, the permits are not being granted in view of the construction work of the fly over and alternative mode of transportation available to the people. In view of the said fact, we do not find that any direction can be issued for grant of permits in the pending applications.
