JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-04-2022 At the outset of argument, it is submitted that due to typographical error name of the petitioner has been typed as Moran Das in place of Maran Da and in the impugned order dated 17.09.2021 in the 2nd line anticipatory bail has been mentioned in place of regular bail, which has been corrected vide order dated 04.04.2022, and certified copy has been filed with the supplementary affidavit.

Let the error be corrected.

Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 435, 379 of the Indian Penal Code, u/s 3⁄4 of Explosive Substance Act and under different Sections of UAP Act.

As per the prosecution case, 56 named and 15-20 unknown Naxalites exploded block office and also burnt tower

Patna High Court CR. MISC. No.61615 of 2021(4) dt.25-04-2022 2/2 and trucks after tying hands and legs of driver and Khalasi of the truck.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has been implicated in the case only on suspicion. No incriminating article has been recovered from the conscious possession of the petitioner and till date no Test Identification Parade has been carried out. Similarly situated accused Heera Yadav has already been granted bail by a co-ordinate Bench of this court vide order dated 24.06.2015 passed in Cr. Misc. No. 19253/2015. Petitioner is in custody since 02.02.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui in connection with Khaira PS case No. 50/2012.
