2. The petitioner has preferred this application for grant of regular bail in connection with Puraini P.S. Case No. 179 of 2024 dated 10.09.2024 registered for the offences punishable u/ss 140(2) and 309(4) of the B.N.S.

3. As per the prosecution case, the grandson of the informant namely, Satyam Kumar was kidnapped by 6-7 miscreants and demanded Rs. 2,00,000/- as ransom when the informant went to his godown, he did not find his grandson. The neighbours told that there were six to seven miscreants on three bikes and they also disclosed the name of the accused persons named in the F.I.R.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R. During the course of investigation, police arrested several named accused persons and recorded their confessional statements but not a single co-accused persons has disclosed the name of the petitioner as their associate. No T.I.P. has been conducted by the prosecution. Nothing has been recovered from the conscious possession of the petitioner. The victim was recovered and his statement was recorded u/s 183 of the B.N.S.S. in which he disclosed that the petitioner along with the other two accused persons were identified by the alleged victim as stated in para 12 of the bail petition.

Save and except, there is no any cogent material available on record to connect the petitioner with the alleged occurrence. The co-accused person has already been granted regular bail by a Coordinate Bench of this court vide order dated 27.05.2025 passed in Cr. Misc. No. 34661/2025. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 20.02.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.51288 of 2025(2) dt.16-09-2025 3/3 of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Uda-Kishunganj, Madhepura in connection with Puraini P.S. Case No. 179 of 2024.

7. The application stands allowed.
