====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-09-2024 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 8(c), 21(c), 29, 35 of the Narcotic Drugs and Psychotropic Substances Act.

3. As per prosecution case, on secret information, a raid was conducted and several cartons containing intoxicating drugs were recovered on which the name 'Rakesh Baita DBG (in Hindi)' was mentioned.

4. Learned counsel for the petitioner submits that the alleged cartons have been found lying by the road no incriminating material has been recovered from conscious possession of the petitioner. Petitioner has got no concern with the alleged drug cartons and claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Darbhanga in connection with Laheriasarai P. S. Case No. 212 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
