1. Heard learned counsel for the petitioners and learned AC to SC-19.

Learned counsel for the petitioners submits that the instant writ application has been filed seeking quashing of the notices issued by the respondent no. 4 i.e. the Circle Officer, Barauli, Gopalganj dated 22.09.2021 whereby the respondent no. 4 has directed the petitioners to remove the encroachment on Plot No. 451, Khata No. 179, Thana No. 260 incomplete ignorance of the report of the Revenue Karamchari, Barauli and Circle Inspector, Barauli dated 28.08.2012 and 31.08.2012.

Learned counsel for the petitioners submits that the notice is misconceived as such the petitioners have filed an application by registered post before the Collector, Gopalganj raising their grievances. It is further submitted that if the writ application is disposed of with a direction to the Collector, Gopalganj to dispose of the representation of the petitioners dated 17.09.2021, the same would satisfy the petitioners.

Learned State Counsel submits that had the Collector, Gopalganj received the notice dated 17.09.2021 sent by registered post, the same by now would have been disposed of, as such, it appears that the representation of the petitioners has not been received by the Collector, Gopalganj on which learned counsel for the petitioners submits that a fresh representation shall be filed on or before 18.11.2024.

5. After hearing learned counsel for the parties, without going into the merits of the case, the writ application is disposed of with a direction that in the event, if the petitioners file a representation before the Collector, Gopalganj, he shall dispose of the same within a period of three months from the date of receipt/production of a copy of this order.
