The petitioner apprehends his arrest in Azam Nagar P.S. Case No. 75 of 2016 registered for the offences punishable under Sections 341, 323, 307, 354, 452, 504 and 506 of the Indian Penal Code.
The informant filed complaint case on the basis of which the FIR was registered. The complainant alleged that when she went to save her husband the petitioner assaulted with Pharsa on her head.
It is submitted that the occurrence took place on 10.01.2016, but the informant filed the complaint case on 19.01.2016. During the course of investigation the investigating officer enquired from the informant Rozi Khatoon about the
Patna High Court Cr.Misc. No.19487 of 2016 (3) dt.20-07-2016 2/2 treatment of her injury but she did not produce any paper of treatment. The investigating officer did not get any injury report nor the son of the informant disclosed as to where she was treated by the doctor.
Considering the facts aforesaid and the fact that the complaint itself was filed after nine days of the occurrence, there is a counter version and there is no injury report of the informant, the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in Azam Nagar P.S. Case No. 75 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
