JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-07-2018 Heard the learned counsel for the petitioner and State. The petitioner is in custody in connection with Maheshkhunt P.S. Case No. 167 of 2017 for the offence under Sections 30(a), 41(1) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that petitioner has suo moto surrender in the instant case on 04.06.2018. Learned counsel submits that allegation against this petitioner is that he was driver of the pick-up van which was standing on NH-11 and from that pick-up van 302 liters liquor was seized. Learned counsel further submits that petitioner has no concern either with the vehicle or with the liquor. Considering the fact that the petitioner has remained in custody for more than one month the petitioner, named above,

Patna High Court Cr.Misc. No.40975 of 2018(2) dt.11-07-2018 2/2 is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I-cum-Special Judge, Excise, Khagaria, in connection with Maheshkhunt P.S. Case No. 167 of 2017.
