JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-07-2018 Heard the learned counsel for the petitioner and State. The petitioner is in custody in connection with Special Case No. 4653 of 2018 arising out of Bypass P.S. Case No. 138 of 2018 for the offence under Sections 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 17.05.2018 in connection with seizure of 20.800 milliliter liquor. Learned counsel submits that liquor was recovered in a bag lying inside the road and as such only suspicion the petitioner was arrested in this case.

Considering the fact that petitioner has no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-

Patna High Court Cr.Misc. No.41282 of 2018(2) dt.11-07-2018 2/2 (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Special Case No. 4653 of 2018, arising out of Bye-pass P.S. Case No. 138 of 2018.
