JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,341,323,332,333,337,338,353 and 427 of the Indian Penal Code.
The prosecution case is that on death of a patient treated by the petitioner the family members and others attacked the clinic of the petitioner on 23.6.2015 after putting the dead body on GT Road, blocked the road when police reached at the spot and asked about such action then the accused persons got agitated and started pelting stones. It is alleged that the petitioner and other accused persons were not ready to clear the blockade and were raising
Patna High Court Cr.Misc. No.20506 of 2016 (2) dt.12-05-2016 2/2 slogans against the police.
It is submitted by the learned counsel for the petitioner that petitioner tried to save the patient but the patient died and the mob damaged the medical clinic of the petitioner and for the same incident two cases were registered; one by the relative of the victim and the other by the police and the petitioner is on bail in both the cases. It is further submitted that the blockade was made by the mob who were protesting against the petitioner. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with nagar (Aurangabad) P.S. Case No. 259 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
