Let the defects, as pointed out by the office, be removed within four weeks of start of normal functioning of the physical court.

Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

According to prosecution case, the informant Chinta Devi in her application before the S.H.O. of Bikram police station Patna alleging therein that on 02.06.2021 her husband went to take milk by his Scorpio vehicle at Bikram, but later on she got information that her husband was killed by the F.I.R. named accused persons including this petitioner. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in the

Patna High Court CR. MISC. No.60805 of 2021(3) dt.25-04-2022 2/2 present case only on the basis of suspicion. He further submits that there is no eye witness of the alleged occurrence. He further submits that the date of occurrence took place is 02.06.2021 but the present F.I.R. has been instituted on 04.06.2021 after delay of two days without explanation of delay. He further submits that nothing has come against the petitioner during the investigation. The petitioner is in custody since 06.08.2021. The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner and submits that para 45 and 46 of the case diary it has come that the statement of the son of the victim namely Bablu Yadav and Biru Kumar @ Lalu Kumar was recorded and they confessed that they hire the petitioner and other persons for committing murder of the deceased and there is sufficient material against the petitioner. He further submits that petitioner carries two criminal antecedents other than the present one.

Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail in connection with Bikram P.S. Case No. 97 of 2021 pending in the court of learned Additional Chief Judicial Magistrate-VI, Danapur, Patna. Prayer is refused.
