The petitioner seeks bail in connection with Sursand (Bitha O.P.) P. S. Case No.56 of 2021, instituted for the offences under Sections 457/ 380 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 19.06.2021, charge-sheet has been submitted in the case and has antecedent of one case. Allegation is of committing theft in the house of the cousin brother of the informant by unknown accused. The learned counsel for the petitioner submits that F.I.R. was against unknown and name of this petitioner transpired in the confessional statement of Md. Samim Ansari and the petitioner was already in custody in another case and he

Patna High Court CR. MISC. No.61362 of 2021(2) dt.22-03-2022 2/2 was also made to confess his participation in the present occurrence.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and taking into consideration the submissions made by the learned counsel for the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sursand (Bitha O.P.) P. S. Case No.56 of 2021.

The application stands allowed.
