JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-07-2018 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Banmankhi Police Station Case No. 2/2018, disclosing offences under Sections 363, 366(A)/34 of the Indian Penal Code.

Allegation against the petitioners and others is of kidnapping the minor daughter of informant and committing rape on her.

Learned Counsel for the petitioners has submitted that they have been made accused in this case due to enmity and has no role to play and further there is no allegation against these petitioners is of committing rape on the daughter of informant.

Patna High Court Cr.Misc. No.40938 of 2018 (2) dt.16-07-2018 2/2 Learned counsel for the State opposed the prayer for bail on the ground that the victim girl in her statement recorded under Section 164 Cr.P.C. has named the petitioners. Having heard both sides, considering the facts and circumstances of the case as well as the nature of offence, I am not inclined to grant them the privilege of anticipatory bail. This application is accordingly dismissed.
