JUSTICE SATYAVRAT VERMA ORAL ORDER 28-01-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. The petitioner seeks bail in connection with Taraiya P.S. Case No. 257 of 2021 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 08.08.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that allegation is of recovery of 720 litres of liquor from a Scorpio and the petitioner was apprehended while he was trying to flee. Learned counsel for the petitioner submits that the petitioner is neither the owner nor the driver of the said Scorpio or the motorcycle and he came to be implicated falsely in the
Patna High Court CR. MISC. No.61981 of 2021(2) dt.28-01-2022 2/2 present case merely because he had taken lift in the Scorpio without knowing what was kept there by the driver who fled away from the place of occurrence.
Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 08.08.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Saran in connection with Taraiya P.S.
