JUSTICE ARUN KUMAR ORAL ORDER 11-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 16.2.2018, seeks bail in GRP (Rail) Danapur PS Case No. 5 of 2018 registered under Sections 379, 420, 120B and 411 of the IPC.

The allegation in brief is that the informant was given an proposal by the petitioner and one Pandit for doing business with them in Patna and he reached there but while he was returning back to his home by train, accused Pandit accompanied him and get away his bag containing one lakh rupees.

Learned Counsel for the petitioner submits that there is no allegation against the petitioner of taking away the money rather the same is against Pandit who has been admitted to bail by a coordinate Bench of this Court vide Cr. Misc. No. 37185 of 2018 and the recovery of thirty thousand rupees cash is personal money of the petitioner and he has no criminal antecedent. Having considered the said facts and circumstances, the petitioner, namely, Arun Kumar Singh @ Arun Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM Railway, Patna in connection with GRP (Rail) Danapur PS Case No. 5 of 2018.
