NILU AGRAWAL ORAL ORDER 22-06-2016 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Pratapganj P.S.Case No. 22/2015 registered for offences alleged under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.
The prosecution case, as lodged by the informant, who is Panchayat Secretary, Bhawanipur North, Gram Panchayat is that the petitioner being an applicant of Teacher- Niyojan had applied, her application form on the basis of T.E.T. eligibility
Patna High Court Cr.Misc. No.21201 of 2016 (2) dt.22-06-2016 2/3 certificate, has been found to be forged during the course of enquiry.
It has been submitted by the learned counsel for the petitioner that she has neither appeared for interview nor has the petitioner secured appointment on the basis of forged certificate. It has also been submitted that a large scale enquiry was conducted and many applicants have been found to have been submitted their applications on the basis of forged T.E.T. eligibility certificates against whom F.I.R. have been lodged. It has further been submitted that the petitioner has clean antecedent as is evident from paragraph-3 of this application and co-accused on similar allegations have since been granted the privilege of anticipatory bail by a Coordinate Bench of this Court in Cr. Misc. No. 50416 of 2015 dated 10.11.2015 and in Cr. Misc. No. 17931 of 2016 dated 05.05.2016.
Be that as it may, since the petitioner has not secured any job, nor appeared any test or interview and similar co-accused have already been granted the privilege of anticipatory bail, let the above named petitioner namely, Arti Kumari in the event of her arrest or surrender before the Court below within a period of eight weeks from today be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Birpur (Supaul) in connection with Pratapganj P.S.Case No.
Patna High Court Cr.Misc. No.21201 of 2016 (2) dt.22-06-2016 3/3 22/2015, subject to the conditions as laid down under Section 438
(2) of the Code of Criminal Procedure.
