The petitioner is in custody in connection with Bela P.S. Case No. 228 of 2019 under section 392 of the Indian Penal Code.

The section under which the petitioner is in jail does not reflect the gravity of the offence he has committed in past and a bare perusal of the para-3 of the bail application shows that he is accused in 8 cases under various sections i.e. 302, 395, 399, 307 and 354 of the Indian Penal Code and Section 25(1-b) a 26, 35 of the Arms Act.

The FIR was lodged in 2019 alleging that the informant who runs customers care service center of the State Bank of India withdrew an amount of Rs. 2,40,500/- and further next day he withdrew Rs. 1, 93,000/- and lastly on third day he

Patna High Court CR. MISC. No.61454 of 2021(2) dt.21-04-2022 2/2 withdrew 80000/- totaling Rs. 5,12,000/-. He kept it in a bag and proceeded from Sitamarhi to his Center Naranga. In the bag, besides the amount there was also Transaction Register, ATM Cards, Aadhar Card, Registration Paper of the vehicle, Pan Card and the Driving License. Later as he was moving he was over taken by six persons on three motorcycles and at the point of pistol the bag was snatched and they fled towards Naranga. The name of the petitioner came up during the course of the investigation but he chose to evade arrest. The matter is of 2019 and as per para-17 of the bail application he finally came into judicial custody only on 22.7.2021.

Considering the aforesaid facts, the number of cases against him and the defiance attitude of the petitioner in evading arrest, this Court is not inclined to grant any relief to him for the present. The bail application is hereby rejected. (Rajiv Roy, J) Ravi/- U T
